Can my parents go through my phone even though I am 18? (2024)

Fresno, CA asked in Family Law and Civil Rights for California

They will go through my texts, photos, and social media just because they bought me the phone, they no longer pay for the phone just the data, and I feel like I don't have any privacy when it comes to my life.

A:You pose a really good question.

When a person turns 18 years of age, they are considered an adult, with all the rights and privileges which come with being an adult. So realistically, if the phone was a gift to you by your parents before you were an adult, since you are now an adult you have a right to privacy in all your affairs, including your mobile phone.

Now the question is whether you are still living in their home. You haven't disclosed this fact. If you are, it only makes sense that if you are living at home with your parents, they still have the right to make the rules with which you must comply if you want to stay there. Nevertheless, there comes a time when the child becomes an adult that you must set your own boundaries. You do that in an adult manner by discussing your feelings with your parents, and letting them know you need your own privacy, including with regard to your phone. If you do that and can't accept their rules, then it is time to think about making your own way in the world so then you can make your own rules and have all the privacy you need.

A:No, if you secure a phone you pay for and have a password with, you should be able to maintain your privacy. In addition, you need to realize that, at 18, unless you have a disability that prevents you from living independently, your parents obligation to support you (food, lodging, medical care, transportation) came to an end. It might be best to discuss the issues with your parents, as I suspect, as an 18 year old, you may not be in a position to live independently at this time.
